These Terms of Service ("Terms") govern your use of the Infera Up mobile application and related services (the "Service") provided by HEED GROUP ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service. By using the Service you represent that you meet these requirements.
2. The Service
Infera Up is a personal finance management tool that helps you view, categorize, and understand your finances. With your authorization, we connect to your financial accounts through third-party providers to import account and transaction information, and we use automated tools, including AI, to categorize transactions and generate insights.
3. Not Financial, Investment, Tax, or Legal Advice
The Service is provided for informational and organizational purposes only. It does not provide financial, investment, tax, accounting, or legal advice, and nothing in the Service should be relied upon as such. Categorizations, projections, runway estimates, and other insights are generated automatically, may be inaccurate or incomplete, and are not a substitute for professional advice. You are solely responsible for your financial decisions.
4. Account Registration and Security
You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. We offer optional security features (such as two-factor authentication and biometric app lock); you are responsible for enabling and maintaining appropriate protections.
5. Third-Party Services and Account Connections
The Service uses third-party providers, including Plaid Inc., to connect to your financial institutions. By connecting an account, you authorize us and our providers to access and transmit your financial data as needed to provide the Service. Your use of Plaid is also governed by Plaid's end user policies. We are not responsible for the acts, omissions, or accuracy of third-party providers or financial institutions.
6. Acceptable Use
You agree not to misuse the Service, including by attempting to access data that is not yours, reverse-engineering the Service, disrupting its operation, or using it for any unlawful purpose.
7. AI-Generated Content
Certain features use artificial intelligence to categorize transactions and produce summaries and insights. AI output may contain errors and should be independently verified. We do not guarantee the accuracy of AI-generated content.
8. Privacy
Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms.
9. Termination and Account Deletion
You may delete your account at any time from within the app (Settings → Delete Account Permanently), which removes your associated data from our systems, subject to any retention required by law. We may suspend or terminate access if you violate these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date, and your continued use of the Service constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
